These FORES26 Attendee Terms & Conditions (“Terms & Conditions”) apply to your registration, attendance, and participation at the Qualia Future of Real Estate Summit 2024 event (the “Event”). By clicking “Order Now”, registering for, or otherwise attending or participating in the Event, you agree to be bound by these Terms & Conditions.

1. Payment

Your attendance at the Event is subject to your payment of all applicable fees and taxes. Registration fees are exclusive of applicable taxes and duties, including without limitation, VAT, excise taxes, sales and transaction taxes, and gross receipts taxes. You are responsible for paying all applicable taxes and other governmental fees, charges, penalties, interest, and other amounts related to the transactions and payments under these Terms & Conditions. Payment of all registration fees and taxes is due at the time of registration.

2. Cancelations & Refunds

Cancellation requests received in writing before February 26, 2026 are eligible for a full refund of the registration fees, less a $100.00 processing fee. Cancellation requests received in writing between February 27 - March 29, 2026 will be eligible for a 50% refund, less a $100.00 processing fee. Refunds will be processed within 30 days after the Event. Refunds will not be granted for any cancellation submitted after March 30, 2026, nor will they be issued for no-shows. Qualia in its discretion may permit substitutions in the event a registrant cannot attend. Requests to substitute an attendee must be submitted to Qualia at events@qualia.com no later than April 13, 2026 Please notify Qualia of any cancellations by emailing events@qualia.com. Registration fees are otherwise non-refundable and Qualia will not be required to reimburse you for any travel expenses, cancellation charges, or other losses associated with any cancellation of the Event.

3. Event Code of Conduct

1. You agree to treat all other Event attendees and staff, whether in-person or virtually, with respect.

2. You will at all times be considerate of other Event attendees and staff.

3. You will not harass, intimidate, or attack any other Event attendees or staff in any way.

4. You will promptly alert Qualia or Event venue staff of any violation of this Event Code of Conduct of which you become aware or reasonably suspect.

5. Without limiting the foregoing, the following behavior is expressly prohibited at the Event:

6. Intimidating or threatening behavior whether verbal or physical.

7. Behavior that could be construed as harassment or discrimination (including on the basis of age, race, national origin or ethnicity, gender, disability, sexual orientation, or physical appearance).

8. Lewd, profane, or sexually suggestive language or conduct.

9. Any language or conduct that disrupts the Event or any presentation.

10. Destruction or vandalism of any personal property or the Event venue.

11. The unlawful possession of any weapons.

12. Any drug use or unauthorized consumption of alcohol.

13. Qualia may revoke your right to attend or participate in the Event, whether in-person or virtually, without liability or further obligation if Qualia believes you have failed to comply with any provision of these Terms & Conditions or any instruction by Qulalia or the Event venue.

4. PUBLIC HEALTH MEASURES & PRECAUTIONS

Qualia or the Event venue(s) (e.g., JW Marriott Austin, etc.) may implement and require practices to promote the health and safety of attendees. These precautions may include vaccination or negative testing requirements, mask requirements, and social distancing among others. These precautions may be established at any time leading up to or during the Event. Each attendee agrees to comply with all health and safety requirements imposed by Qualia or any applicable venue.

5. Your Information

1. Except as otherwise described in these Terms & Conditions, Qualia will collect, use, and disclose non-public personal information about you according to the Qualia Privacy Policy.

2. Qualia may provide your name, company and contact information to sponsors of the Event (“Event Sponsors”) and other attendees of the Event unless you opt out of providing that information. You may opt out of being included in an attendee list that Qualia shares with Event Sponsors and other attendees by informing Qualia of that choice at events@qualia.com.

3. You will not harass, intimidate, or attack any other Event attendees in any way.

4. You understand that Qualia will be capturing photographs, digital images, and video or audio recordings in which you may appear (collectively “Recordings”). By attending the Event, you consent to the creation of these Recordings and agree to the following: You grant Qualia a perpetual, irrevocable, worldwide, sublicensable, royalty-free license to use, store, copy, modify, create derivative works of, display, perform, broadcast, and distribute the Recording, including your voice, name, image, and likeness, in any media for any marketing, publicity or other legitimate business purpose. You waive any right to review or approve any particular use of the recordings. You agree that Qualia will have exclusive ownership of any suggestions, ideas, or other feedback you provide, and Qualia may use any such feedback for any purpose without compensation or attribution to you. To the full extent permissible under applicable law, you release and discharge Qualia and its employees, officers, directors, and agents from any and all claims, including those based on publicity or privacy rights, liabilities, or expenses of any kind arising out of any use of the Recordings as permitted herein. You represent that you are at least 18 years of age and agree that this consent is irrevocable. Attendees may opt out of being photographed or recorded at the Event by sending an email request to events @ qualia.com prior to or at the start of the Event. If you opt out, Qualia will make reasonable efforts to avoid including you in any Recordings. The foregoing consent and license grant applies only to attendees who do not opt out as described above.

6. EVENT MATERIALS

By attending the Event, you acknowledge that the documents, materials or other information disclosed or otherwise shared at the Event (“Event Materials”) by Qualia are confidential and proprietary to Qualia. You agree not to record, reproduce, or share Event Materials without Qualia's explicit written permission. Use of any Event Materials is only permitted for your internal and non-competitive business purposes.

7. ASSUMPTION OF RISK AND LIMITATION OF LIABILITY

1. You acknowledge and agree that attending the Event is voluntary. To the maximum extent permitted by law, you assume all risk, responsibility, and liability associated with your attendance and participation at the Event.

2. To the maximum extent permitted by law, you (for yourself and anyone else who might make a claim on your behalf) hereby release Qualia and its affiliates, and their respective directors, officers, employees, contractors, representatives, agents, successors, and assigns, from any and all claims, demands, causes of action, suits, damages, losses, debts, liabilities, costs and expenses (including without limitation attorneys’ fees and costs) that you may have now or in the future related in any way to the Event or the Recordings.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER QUALIA NOR ITS AFFILIATES, LICENSORS, OR CONTRACTORS WILL BE LIABLE TO YOU UNDER ANY CAUSE OF ACTION OR THEORY OF LIABILITY, EVEN IF A PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, FOR (A) INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR (B) LOST PROFITS, REVENUES, CUSTOMERS, OPPORTUNITIES, OR GOODWILL. IN ANY CASE, QUALIA’S AGGREGATE LIABILITY UNDER THESE TERMS WILL NOT EXCEED USD $250.

7. ASSUMPTION OF RISK AND LIMITATION OF LIABILITY

1. Entire Agreement. These Terms & Conditions represent the entire agreement between you and Qualia regarding their subject matter, including your right to attend and participate in the Event.

2. Assignment. Except as expressly provided by these Terms & Conditions, your rights hereunder are non-assignable and non-transferable. Any purported assignment in violation of this Section will be void. Qualia may assign or transfer any rights or obligations under these Terms & Conditions in its sole discretion. Subject to the foregoing, these Terms & Conditions will be binding upon and inure to the benefit of the parties and their respective permitted successors and assigns.

3. Severability. If any part of these Terms & Conditions is held to be invalid or unenforceable, the remaining portions of these Terms & Conditions will remain in full force and effect. Any invalid or unenforceable portions will be interpreted to affect the intent of the original portion. If such construction is not possible, the invalid or unenforceable portion will be severed from these Terms & Conditions, but the rest will remain in full force and effect.

4. Force Majeure. Qualia and its affiliates will not be liable or responsible for any delay or failure of performance resulting from any cause beyond Qualia’s reasonable control, including without limitation, acts of God, labor disputes, electrical or power outages, utilities or other telecommunication failures, earthquake, storms, or other acts of nature, pandemics, blockages, embargoes, riots, acts or orders of government, acts of terrorism, war, or the threat of transmissible disease.

5. Governing Law & Jurisdiction. These Terms & Conditions shall be governed by the laws of the State of California, without regard to any conflicts of law rules. Any legal dispute arising out of, or related to, these Terms & Conditions shall be brought in the state or federal courts located in San Francisco County, California. You and Qualia each consent to the exclusive jurisdiction of such courts with regard to any dispute arising out of, or related to, these Terms & Conditions.

6. Modification. Qualia may modify or update these Terms & Conditions at any time upon written notice in any form (including by email). By attending the Event, you agree to be bound by such modified or updated Terms & Conditions.
